Abuse Policy

This policy outlines how VineHost handles data requests from authorised legal entities, including court orders, subpoenas, preservation requests, and emergency cases. We comply with applicable UK laws and prioritize customer privacy in every data disclosure process.

Types of Data Requests
VineHost may receive various types of data requests from government agencies, law enforcement, or other authorized entities:

  1. Data Requests: These are formal requests for account information or documents related to investigations, typically requiring a valid legal process (e.g., subpoena, court order).

    • Examples: Subpoenas, court orders, and search warrants related to civil or criminal proceedings.
     
  2. Preservation Requests: These requests ask VineHost to retain specific account information for ongoing investigations.

    • Requirements: Requests must include account identification details, the nature of the investigation, and assurance that further legal process will follow.
     
  3. Emergency Requests: Requests made when there is an imminent threat of bodily harm or death.

    • Procedures: Emergency requests are evaluated and handled immediately to prevent serious harm, and data may be released in good faith.
 

Process for Submitting Requests
To submit a data request, please provide the following details:

  • Account Identification: Include the customer’s full name, associated email address, domain name, and IP address.
  • Requesting Agency and Investigation Details: Requests should be on official letterhead and specify the investigation or proceeding.
  • Contact Information: Provide a valid email address and phone number for follow-up.
 

Requests should be emailed to [email protected] or mailed to VineHost’s Legal Team using the address at the bottom of this policy. Note that we may charge fees to cover the costs associated with processing requests.

Response and Disclosure Policy
VineHost reviews each data request individually, following these steps:

  1. Legal Compliance: We verify the legal validity of each request and ensure it complies with UK laws and data protection regulations.
  2. Customer Notification: Where possible, we inform customers about data requests related to their accounts unless prohibited by law.
  3. Types of Data Available:
    • Non-Content Data: Basic information like account holder name, email, and IP logs, provided upon valid request.
    • Content Data: Accessible only under a search warrant from an authorised legal entity and includes data such as stored files or emails.
     

Data Retention and Fees
Depending on the type and volume of data requested, we may charge fees for processing, particularly if the request is complex. We retain data only as long as required by law, after which it is securely erased.
